Bima Arya: The Jakarta Governor's Regulation On ASN Polygamy Is Created To Tighten Marriage And Divorce Rules

Deputy Minister of Home Affairs Bima Arya stated that Governor Regulation Number 2 of 2025, which allows civil servants in Jakarta to practice polygamy, aims to tighten the processes of marriage and divorce. He made this announcement after meeting with Jakarta's Acting Governor Teguh Setyabudi at City Hall on January 20, 2025. Bima explained that the regulation is designed to make polygamy for civil servants more difficult, to prevent easy marriages and divorces. He noted that the regulation was introduced due to a rise in divorce cases among civil servants in Jakarta in 2024, totaling around 116 cases. Bima highlighted that behind these divorces are various issues, including the neglect of former wives' rights. To address this, the Jakarta provincial government created rules to ensure that marriages, divorces, and polygamy have a strong legal foundation. Bima emphasized that the regulation aims to provide legal certainty and clearer rules regarding divorce and marriage processes. He clarified that while the regulation permits civil servants to engage in polygamy, it cannot be done casually. Bima stressed the importance of protecting all family dynamics, given the high divorce rates. He also mentioned that the regulation is based on Presidential Regulation Number 45 of 1990 and a circular from the National Civil Service Agency, meaning it does not introduce new norms. Previously, Acting Governor Teguh Setyabudi officially issued Governor Regulation Number 2 of 2025 on January 6, 2025, which outlines the procedures for granting permission for marriage and divorce, including for civil servants wishing to have multiple wives.

In this rule, male civil servants who want to practice polygamy must get permission from the authorized official before getting married. This requirement is stated in Article 4, paragraph 1. If a civil servant breaks this rule and marries without permission, they will face severe disciplinary action as outlined in the applicable laws.
