The Constitutional Court has granted part of the judicial review request made by Edi Iswadi, the Head of Bojongsari Village in Kebumen, Central Java. The court ruled that incumbent regional leaders must take a leave of absence without state funding and are prohibited from using official resources during the campaign period, the quiet period, and on election day. Edi Iswadi, along with his lawyer Aksin, expressed gratitude for the decision announced by Chief Justice Suhartoyo on Thursday, January 2, 2025. Aksin explained that this ruling reinterprets Article 70, paragraph (3) of Law No. 10 of 2016 regarding the election of governors, regents, and mayors. Previously, this article only required incumbents to take leave during the campaign, allowing them to return to office and use their official resources afterward, including during the quiet period and on election day.
Aksin noted that under the old rules, incumbents could misuse their authority and resources. This situation was seen as a violation of fair and honest election principles. He pointed out that incumbents could still leverage their resources even while on leave. The court accepted the arguments presented by the applicant. Chief Justice Suhartoyo also mentioned that without stricter time limitations, incumbents have a significant potential to abuse their power. Aksin expressed relief that their request was granted, viewing the decision as a revival of democracy.
He emphasized the need for an extended leave period for incumbents, including during the quiet period and on election day, to ensure fairness, equality, and equal rights during elections.
