Judges Of The Constitutional Court Should Avoid Conflicts Of Interest And Not Handle Election Cases From Their Own Regions

The Constitutional Court judges will not handle election dispute cases from their own regions in the 2024 Regional Head Elections. This decision aims to prevent any conflicts of interest between the judges and the parties involved. "We are considering several factors to avoid any potential conflicts," said Pan Mohamad Faiz, the Head of the Public Relations and Protocol Bureau, in a text message on Saturday (January 4, 2025). "For example, judges will not deal with cases from their own regions," he added. Additionally, the court has arranged for the election cases to be heard in panels. The nine judges will be divided into three panels, each consisting of three judges. The panel structure will be the same as for the 2024 legislative candidate election cases. Panel I will be led by Suhartoyo, with Daniel Yusmic Foekh and Guntur Hamzah. Panel II will be chaired by Saldi Isra, with Ridwan Mansyur and Arsul Sani. Panel III will have Arief Hidayat as the chair, along with Enny Nurbaningsih and Anwar Usmman. "We need three panels because there are many cases, and the court has a 45-working-day deadline. If we don't use parallel panels, we might not meet the timeline," Faiz explained. The first hearing for the 2024 election disputes will take place on January 8, 2024, covering 309 registered cases, including 23 gubernatorial disputes, 49 mayoral disputes, and 237 regency disputes.
